FindDish Terms of Use
1. Who we are
FindDish is run by Konstantin Kosolapov, a sole trader (autónomo) established in Spain, NIF ESZ1846937L, with address at 08027, Barcelona, Carrer de Coll, 59, Baixos 1a. Contact for questions, complaints or claims: support@finddish.app, +34662668061.
That email is also our single point of contact for users and for authorities under the EU Digital Services Act. You can write to us in Spanish, Catalan or English.
2. What FindDish does, and how you accept these terms
You photograph a restaurant's menu, or open its QR code, and FindDish reads it, translates it and suggests dishes according to the taste you have told it about. It also shows a map of places and menus that have already been read. FindDish is free. These terms apply whenever you use it, as a guest or with an account.
The first time you open the app it asks you to read and accept these terms and the privacy policy, to confirm your age and, in a box of its own, to agree to the use of outside AI services. That is the only step, and the app does not open without it. Until you accept you can read them or leave, and if you got something wrong you can go back. Nothing is created for you until you accept. We keep a record of what you accepted, with its version, language and date, and you can see it in Profile, under About FindDish. The text is always at this address, and you can save or print it. These terms are available in Spanish, Catalan and English.
3. Age
You must be at least 14 years old to use FindDish. You confirm this when you first open the app, and if you say you are younger, no account is created. If an account already exists on the phone, the app stops and offers to delete it. If we otherwise learn that an account belongs to somebody under 14, we delete it.
4. Your account
The app gives you a guest account when you accept these terms. A guest account is tied to that phone: if you sign out of it, remove the app or do not open it for 30 days, nobody can open it again, and neither can you. We then delete it after 90 days without activity, as the privacy policy explains. You can sign in at any time with Apple, Google (on the systems that offer them) or a code sent to your email, and what you have done so far comes with you. Keep your sign-in methods secure. You can delete your account at any time in the app, under Profile.
5. Allergies and food: please read this
FindDish does not guarantee that a dish is free of any allergen or ingredient. Always check with the waiter or the restaurant staff before you order or eat, every time. If your allergy is severe, do not use FindDish to decide what is safe to eat.
- We go by what the menu says. Menus can be incomplete, out of date or wrong, and they do not tell you about traces or cross-contact in the kitchen.
- We read and translate menus with artificial intelligence, and it also works out from a dish's name and description which allergens the dish may have. It can misread, mistranslate, miss something or invent it. A dish shown with no allergens may still contain them.
- We check the 14 allergens that EU law requires to be declared, and any allergy you add in your own words. An allergy you add is searched only as the words you confirmed, in what is written in the menu's dish name, description and ingredients. Anything else is not taken into account.
- The card for the waiter is an aid to help you explain yourself. It does not replace speaking to the staff, and a translation may contain mistakes.
- Match percentages, nutrition figures and dish information are estimates. Pictures marked "AI illustration" are generated by AI, and do not show that restaurant's plate.
- FindDish gives no medical or dietary advice and is not a medical device. If you have an allergic reaction, call 112 or your local emergency number.
6. Artificial intelligence
Parts of FindDish depend on outside AI services: reading menus, understanding your voice and what you write, searching by meaning, and checking photographs. You agree to this on the first screen. If you take it back in Profile, the app still opens as usual, and these stop working until you turn the switch back on, except search, which keeps using them with nothing about you. What is sent, and to whom, is in the privacy policy. AI output can be wrong: treat it as a suggestion, and check anything that matters to you.
Please do not mention allergies or your health in a recording or a free text box.
Voice input is for people aged 18 or over, because the company that turns it into text, ElevenLabs, does not allow younger users. When you use voice, you must also respect its terms and prohibited use policy. You allow ElevenLabs and its subcontractors to process your recordings to provide and support that service. Neither you nor we act as its agent or partner. ElevenLabs may enforce this paragraph as a third party.
7. What you send us
You keep your rights over what you send: photographs of menus and dishes, comments, recordings and reports. So that the app can work, you give us a non-exclusive, free licence to store, copy, resize, translate and show it within FindDish and the links people share from it, for as long as it is in the service.
- Menus. The photographs themselves are not shown to other people. What we read from them (dishes, prices, descriptions) joins our catalogue and is shown to everybody, without your name. Photographing a menu does not give you or us rights over the restaurant's own texts or images, and we do not ask you to grant them. A restaurant can ask us to correct or remove what we show at support@finddish.app.
- Photographs of dishes. Once approved, they are shown to other people. If you delete your account, they stay in the catalogue with nothing that says they were yours. You can ask us to remove them at support@finddish.app.
Only send what you have the right to send. Do not photograph people who have not agreed, and do not upload other people's personal data.
8. Zero tolerance for objectionable content
We do not tolerate objectionable content or abusive users. You may not upload or send through FindDish:
- nudity or sexual content, intimate images of anybody without their consent (including ones made with AI), or anything that sexualises minors;
- violence, gore, or threats;
- hate speech, or harassment of any person or group;
- anything illegal, or that infringes the rights of others;
- photographs of identifiable people without their permission;
- spam, or anything that is not what the feature is for (a photograph of a dish must be of a dish).
Every photograph of a dish is checked automatically by an AI model before it is shown to anybody. Anything unclear waits for a person to look at it. People review reports and appeals; no decision on an appeal is taken by automated means alone.
9. Reporting, blocking and what we do about it
- Report. On any photograph, tap ⋯ (Report or block this photograph, or Report this photograph if the person who added it has left). It is hidden from everybody as soon as you tell us. A person then looks at it, normally within 24 hours.
- Block. From the same place you can stop seeing that person's photos, on every screen. They are not told.
- Dish information. On a dish, choose Something about this dish is wrong.
- Illegal content, by email. Anybody can report content to support@finddish.app, including people without the app. Say why you think it is illegal, where exactly it is, your name and email (not needed for sexual abuse of children), and that you believe what you say. We confirm that we received it and tell you what we decided and how you can challenge it. If something suggests a threat to someone's life or safety, we tell the authorities.
If content breaks these terms we remove it or hide it. If a photograph of yours is rejected, the app tells you why.
If a person breaks these terms, a person at FindDish, not a machine, can stop their account from adding photographs, or close it. A closed account can no longer be used, except to delete it, and all its photographs of dishes are hidden. If we open it again, they do not come back by themselves. We tell you why in the app, in the moderator's words: on a closed account the next time you open the app, and on stopped uploads the next time you try to add a photograph. We do not send an email about it.
You can disagree by writing to support@finddish.app: a person will look at it again. You can also go to the courts or the consumer authorities.
10. Other things you may not do
Do not try to get around the app's limits, read data from it in bulk, interfere with how it works, or get into another person's account. Do not use it for anything other than choosing food for yourself and the people with you.
11. Information from others
The places on the map come from open data, credited on the About screen: OpenStreetMap contributors (Open Database License), Foursquare OS Places (Apache License 2.0), and Overture Maps (CDLA Permissive 2.0), which we have combined and changed. The part of our places database based on OpenStreetMap is available under the Open Database License: write to support@finddish.app and we will send it, or a file of our changes, free of charge and in a machine-readable form. Restaurants change their menus and prices, and places close. Prices and dishes shown may be out of date; the menu in the restaurant is the one that counts. We are not connected to the restaurants, unless we say so.
On Android the map is Google Maps. Using it means you also accept the Google Maps terms and Google's privacy policy.
12. If you got the app from the App Store
These terms are between you and us, not Apple. We, not Apple, are solely responsible for the app and its content.
- Licence. You may use the app on Apple-branded devices you own or control, as the Usage Rules in the Apple Media Services Terms allow, including through Family Sharing. This licence cannot be transferred.
- Maintenance and support. We alone provide them, as these terms say or the law requires. Apple has no obligation to do so.
- Warranty. We are responsible for any warranty the law gives you. If the app fails to meet one, you can tell Apple, and Apple will refund the price, if you paid one. To the extent the law allows, Apple has no other warranty obligation, and other claims for such a failure are ours to answer.
- Claims. We, not Apple, answer any claim from you or a third party about the app, including product liability, failure to meet a legal requirement, and consumer protection or privacy claims.
- Intellectual property. If a third party claims that the app or your use of it infringes their rights, we, not Apple, handle that claim.
- Legal compliance. You confirm that you are not in a country under a US embargo or designated as supporting terrorism, and not on a US list of prohibited or restricted parties.
- Contact. Our name, address, telephone and email are in section 1.
- Third-party terms. You must comply with third-party terms that apply when you use the app, such as your mobile data contract.
- Beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, may enforce them against you.
13. Availability and changes
We work to keep FindDish running, but it is free and we cannot promise that it will always be available or free of errors. The law gives you a guarantee that the service matches this contract, and you keep it. We may change or withdraw features. If a change harms your use in more than a minor way, we will tell you in advance and you can end the contract for free. If we are going to close the service, we will tell you in advance, where we can, so that you can export your data.
14. Liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our actions or omissions, for fraud or wilful misconduct, or anything else that the law does not allow us to limit, and nothing takes away your rights as a consumer. Everything else follows the applicable law. Section 5 explains how the app works and what it does not do: it is not a limit on this section.
15. Ending this
You can stop using FindDish and delete your account at any time, for free. If you are a consumer, you can also withdraw from this contract within 14 days without giving a reason: deleting your account or writing to support@finddish.app is enough. We can end your access if you seriously or repeatedly break these terms.
16. Changes to these terms
If we change these terms in a way that matters to you, we will tell you in the app before the change takes effect, and ask you to agree again where the law requires it. If you do not agree, you can delete your account. The date and version above always show which text applies.
17. Law and disputes
Spanish law applies, without taking away any protection given to you by the law of the place where you live. If you are a consumer, you can go to the courts of your place of residence. You can also contact the consumer authorities of your region. If you have a complaint, write to support@finddish.app first, and we will try to solve it.
If this text and the Spanish version differ, the Spanish version prevails.
